Appeals court rules The Pitt resembles ER enough to keep Crichton's lawsuit alive.
Appeals Court Finds 'Clear and Numerous Similarities' Between The Pitt and ER
Warner Bros. Television has lost a major round. On November 4, a three-judge panel of California's Second District Court of Appeal unanimously refused to throw out a lawsuit from Sherri Crichton, the widow of ER creator Michael Crichton, over the Emmy-winning HBO Max drama The Pitt.
The judges pointed to the emergency room setting, the frantic pace, the dense medical jargon, the graphic injuries and a young doctor fresh out of medical school who is clearly out of their depth, and concluded that the evidence was enough for a prima facie case.
The panel did hand the defense one win. It ordered the claims against Noah Wyle, John Wells and R. Scott Gemmill dismissed, finding no evidence that they knew they might be interfering with Crichton's contractual rights.
How ER's Frozen Rights Clause Put The Pitt in Legal Jeopardy
ER's frozen rights clause comes from Michael Crichton's 1994 agreement with Warner Bros. Television, which barred sequels, spinoffs, remakes and other derivative works without his approval. Crichton based ER on a 1974 script drawn from his time as a medical student. His rights are now held by Roadrunner JMTC, which Sherri Crichton controls.
She sued in August 2024, months before The Pitt premiered, alleging it was an ER reboot in disguise launched after revival talks collapsed.

Noah Wyle and The Pitt Producers Walk Away From the Lawsuit
Noah Wyle, along with executive producers John Wells and R. Scott Gemmill, is now out of the case after the panel reversed the lower court's ruling as to them. Wyle has said in interviews that the team first started down an ER reboot road that never came to pass, before The Pitt was fast-tracked.
Warner Bros. Faces a Possible Jury Trial as the Case Moves Ahead
Warner Bros. now heads back to the trial court in Los Angeles, where a jury could decide the case unless the two sides settle, and Deadline reports a trial could come as early as next summer. Judge Wendy Chang had denied the studio's anti-SLAPP motion in 2025.
Sherri Crichton said she was deeply gratified and looks forward to presenting a case that affects writers, creators and their estates to a jury. The Pitt returns for season 3 in January 2027.
Frequently Asked Questions
What did the appeals court decide about The Pitt?
It upheld the denial of Warner Bros. Television's anti-SLAPP motion, allowing Sherri Crichton's breach-of-contract claims against the studio to move forward.
Why does Michael Crichton's widow say The Pitt violates her rights?
She argues the show is derivative of ER, which a 1994 frozen rights provision barred Warner Bros. from making without Crichton's approval.
Are Noah Wyle and the show's producers still being sued?
No. The court ordered the claims against Wyle, John Wells and R. Scott Gemmill dismissed, finding no evidence they knew they might breach Crichton's contract.
Will the Crichton lawsuit go to a jury?
It could. The case returns to the trial court for discovery and may reach a jury in Los Angeles unless the parties settle first.
When does The Pitt season 3 premiere?
Season 3 of The Pitt is set to debut on HBO Max in January 2027.
Conclusion
The Pitt has collected 12 Emmys, but it still cannot shake the shadow of ER. A unanimous appeals panel ruled that the two medical dramas share enough DNA for Sherri Crichton's lawsuit against Warner Bros. Television to continue, while releasing Noah Wyle, John Wells and R. Scott Gemmill from the case. The fight now heads back to the trial court for discovery, with a possible jury trial in Los Angeles unless a settlement arrives first. For a series that became a critical and commercial hit for HBO Max, the question of whether it is an ER reboot in disguise is very much alive.
